American Digital SCADA and Industrial Automation products are warranted to be free from defects in material and workmanship for a period of one year from the date of original purchase. During the warranty period, American Digital will repair or replace and return (freight prepaid), at its sole option, any defective products returned, properly packaged for shipment, prepaid, including copy of sales receipt, with R.M.A. (return authorization) number on shipping carton, and including a written notation of the nature of any failure or malfunction. This Warranty does not cover damage or failure caused by acts of God, abuse, misuse, abnormal usage, faulty installation, improper maintenance, product modification including without limitation appearance, or any repairs other than those provided by American Digital or its authorized agents. Pertinent labor, material, and return transportation charges will apply to repairs on product out of warranty. There are no obligations on the part of American Digital for consequential damages or liabilities arising out of or in connection with the use or performance of the product or other indirect damages with respect to loss of property, revenues, profit, cost of removal, installation, or reinstallation. Purchaser's exclusive remedy for any cause of action relating to the purchase or use of any of the products from American Digital and American Digital's liability for any and all losses or damages resulting from any cause whatsoever including negligence, or other fault, shall in no event exceed the purchase price of the product in respect to which the claim is made, or, at the election of American Digital, the restoration, replacement, or repair of such product. This warranty shall be in lieu of any other warranty, expressed or implied, including without limitation to, any implied warranty, merchantability, or fitness for any particular purpose.
